Country Store applied for Business-Major zoning

BM-CR stands for “Business MAJOR, Commercial Rural.” It permits the
following uses, quoted from the regulations: “Retail sales, personal services, restaurant, bank, office, tavern, food
store, medical clinic, service garage, hotel/motel, theater, warehouse, automobile sales and night club. Typical uses permitted by special exemption: Arcade, car wash, bus terminal, striptease business.” This document is online. The only difference
between BM and BM-CR, again according to the County regulations, is that CR was “[e]stablished to provide basic convenience
shopping and services in rural areas where such facilities are not available within a reasonable distance.”
To quote the Country Stores’ correspondence, “The issue here is repairing lawnmowers.” But things have moved on since then, and now, according to the store’s owner, the business will only
succeed if he can work on engines up to 100 horsepower – although the owner has recently stated to surrounding
home owners that, if asked, he would work on larger engines too. To help

Although some want to characterize
the business as simply tinkering on small engines, the requested zoning change far exceeds the needs of small engine repair. Ridge could have asked for a far more restrictive zoning, like RCC (Resource
Conservation Commercial), which would easily have covered their original request. If
the Ridge property is upzoned to BM-CR or BL for that matter, the Ridge property’s value will rise, to the detriment
of the surrounding homeowners. Likewise the property will in all likelihood become something very different
if sold in the future. Why would anyone at the County support this in a residential
neighborhood? Perhaps no one will - although the County's preliminary recommendation
supports this proposal.
If this zoning
request goes through, it will negatively impact our properties' values, our quality of life, our environment and our future. Let the Zoning Commissioners and our elected representative, Kevin Kamenetz, know how
you feel. Although according to the store’s owner, “this deal is done,” we can make a stand and show him otherwise.
Remember, no zoning changes are required to operate the store. This is
only to permit expansion of the business scope. It must be noted that the County’s
preliminary staff recommendations are to upzone to BL-CR. This is a link to the staff’s recommendation. This would permit: “Retail sales, personal services, restaurant,
bank, office, tavern, food store, medical clinic. Typical Uses Permitted by Special
Exemption: Arcade, car wash, service garage, hotel/motel, funeral establishment, golf course, driving range, animal boarding
place Class A, theater.” The differences between BM-CR and BL-CR are merely
what things are covered as an exemption. This proposed business under BL-CR or
BM-CR is not acceptable in a rural, residential neighborhood. The CR designation
stipulates that the business exist for “basic convenience shopping and services.”
None of the proposed “services” are for these reasons. Basic
convenience shopping? This business (100+HP engines, etc) is not for our convenience
and is a flagrant violation of the zoning requirements and will come back to haunt all of us in the near future. Write, call or e-mail your friends, neighbors and representatives and let them know what you think.
